Distance Sales Contract

This Distance Sales Agreement ("Agreement") has been concluded between the following parties in order to regulate the rights and obligations regarding the sales made through the website www.diandraistanbul.com. The Agreement has been prepared in accordance with the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

Article 1 - Parties

1.2. Recipient

The Buyer is the natural or legal person who places an order through the website www.diandraistanbul.com and has an order number. The contact information provided by the Buyer during the order is taken as basis.

Article 2 - Subject of the Agreement

This Agreement regulates the processes of confirming the preliminary information regarding the basic qualifications, sales price, payment method, delivery conditions, right of withdrawal and return conditions of the product or products purchased by the Buyer electronically through the website www.diandraistanbul.com and ordering the products. The Buyer declares that he accepts the provisions of the Agreement and places an order accordingly.

Article 3 - Product and Delivery Information

The type, type, quantity, brand/model, sales price, payment method, delivery address, delivery address, delivery person, invoice information and shipping fee of the purchased product or products are as stated in the forms filled in by the Buyer during the order and in the order summary. This information forms an integral part of the Contract.

Article 4 - Rights and Obligations of the Seller

4.1. The Seller undertakes to fulfil the obligations specified in the Agreement in full and on time, except for force majeure, in accordance with the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

4.2. The Seller is not responsible for price inaccuracies caused by software or system errors. In such cases, the Seller has the right to cancel the order and refund the price paid by informing the Buyer by e-mail or telephone.

4.3. The Seller reserves the right to cancel the order if it deems necessary, such as non-payment of the order price or force majeure.

4.4. The Seller undertakes to carry out the delivery of the products to the address specified during the order and in accordance with the delivery conditions.

Article 5 - Rights and Obligations of the Buyer

5.1. The Buyer is deemed to have accepted all provisions of this Agreement by placing an order through the website www.diandraistanbul.com and having an order number.

5.2. The Buyer may request a refund within the scope of the right of withdrawal. Refund requests other than the right of withdrawal are subject to the discretion of the Seller within the framework of legal legislation, if force majeure exists.

5.3. The buyer undertakes that the product he/she wants to return is unused, in its original packaging and undamaged, and that the invoice, certificate and other additional documents sent with the product will be returned in full.

5.4. The Buyer declares that the information provided during the order is correct, complete and up-to-date.

Article 6 - Right of Withdrawal

6.1. The Buyer may exercise the right of withdrawal within 14 (fourteen) calendar days from the delivery of the product to him or the person / organisation at the address he notified. In order to exercise the right of withdrawal, within this period, the Seller must send a fax, e-mail (info@diandraistanbul.com) or by telephone (+90 542 326 20 40) and the product must be unused, in its original packaging and undamaged in accordance with the provisions of Article 5.3.

6.2. The product returned within the scope of the right of withdrawal must be delivered to the Seller with the cargo delivery report and the original invoice stating that it has been sent to the Seller. The product price is returned to the Buyer within 10 (ten) business days following the receipt of these documents to the Seller.

6.3. If the original invoice is not sent, VAT and other legal obligations cannot be refunded.

6.4. The shipping cost of the product returned within the scope of the right of withdrawal is covered by the Buyer. However, if the product is returned for a reason caused by the Seller, such as a manufacturing defect or incorrect shipment, the shipping cost is borne by the Seller.

Article 7 - Situations where the Right of Withdrawal cannot be exercised

The right of withdrawal cannot be exercised in the following cases:

• Individually designed or customised products (e.g. necklaces with names inscribed on them), excluding manufacturing defects.
• Earrings or similar products used for hygiene purposes.
• The original packaging of the product has been damaged or used.

Article 8 - Competent Court and Enforcement Office

In the implementation of this Agreement, Consumer Arbitration Committees and Consumer Courts in the settlement of the Buyer or the Seller are authorised up to the value determined by the Ministry of Industry and Trade. If the order is approved, the Buyer is deemed to have accepted all the terms of this Agreement.

Article 9 - Acceptance of the Contract

The Buyer accepts, declares and undertakes that he/she has read all the conditions in this Agreement and in the order-pre-information form which constitutes an integral part of it, all preliminary information such as the basic qualities of the products, sales price, payment method, delivery conditions and right of withdrawal, has confirmed electronically through the information sent to the e-mail address registered on the website www.diandraistanbul.com and in the system and has placed an order accordingly.

Article 10 - Enforcement

This Agreement enters into force upon the Buyer's approval of the order electronically. The Seller agrees to act in accordance with the provisions of the Agreement and the Buyer agrees to fulfil its obligations under the Agreement.
